 We reserve the right to amend this Agreement at any time by posting the amended terms on this page.  By using your Account, you agree to be bound to these terms.

 1. You shall comply with all applicable laws regarding access to your Account. You are responsible for paying all applicable taxes and for all hardware, software, service and other costs you incur to access your Account on our servers.

 2. We may terminate your Account immediately if you breach this agreement or if we decide to discontinue offering accounts (No Refunds will be given).

 3. You may not transfer or share your Account with anyone. You may not disclose your password to any third parties.

 4. Although privacy issues are very important to us, given the current regulatory and technical environment you should not have an expectation of privacy in your Account. By way of example (without limiting the foregoing), we may be forced to disclose private email to the government under certain circumstances and third parties may unlawfully intercept your private email. Therefore, we cannot ensure that all private email will remain private.

 5. WE PROVIDE YOUR ACCOUNT "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee continuous, uninterrupted or secure service, and we are not liable if you are unable to access your Account.

 6. IN NO EVENT SHALL WE BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR FOR INTERRUPTED COMMUNICATIONS, LOST DATA OR LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT. OUR LIABILITY TO YOU OR ANY THIRD PARTIES IS LIMITED TO THE PRORATED MONTHLY FEE YOU PAID.

 7. With respect to any content you distribute through your Account:

     7.1 You are solely responsible for your content, and we act as a passive conduit for your online distribution and publication of your information. However, we reserve the right to remove content from our servers if we believe it may create liability for us.

     7.2 You represent and warrant that any content you distribute or receive through your Account (a) does not infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (b) does not violate any law, statute, ordinance or regulation (including without limitation the laws and regulations governing export control); (c) is not defamatory, trade libelous or unlawfully threatening; (d) is not pornographic or obscene; (e) does not violate any laws regarding unfair competition, antidiscrimination or false advertising, or (f) does not contain viruses, trojan horses, worms, time bombs, cancelbots or other similar harmful or deleterious programming routines. You may not distribute "spam" through your Account, nor may you take any other action which imposes an unreasonable or disproportionately large load on our infrastructure;(g) is posted following the Netiquete.

 8. This Agreement shall be governed in all respects by the laws of the California. Both parties submit to jurisdiction in California and further agree that any cause of action arising under this Agreement shall be brought in the court in Los Angeles, California. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.

 9. We can not give refunds to your account. Please be sure of what you subscribe to. Even if you can not access our service because you are unable to properly configure a software news reader program we can still not give refunds. If you decide to cancel your account we can not refund the unused months.

 10. You agree to a subscription which will be prolonged automatically every month. You are able to cancel your account at the User Maintenance Center at any time.
